Survey Agreement and Disclaimer

Van der Vliet Marine, LLC

I, Mark Van der Vliet, am committed to providing a thorough and accurate survey which meets or exceeds industry standards. The applicable mandatory and voluntary standards set forth by the U.S. Code, the Code of Federal Regulations, American Boat and Yacht Council, and the National Fire Protection Association are used to inspect this vessel. This survey inspection is limited by its very nature, the time, accessibility, and circumstances. The report represents the condition and valuation of the vessel on the date(s) of survey only and is not to be construed as a guarantee of future operation or condition.

Survey services are provided with the understanding that only reasonably accessible areas of the vessel will be surveyed. No inspection will be made of areas that are inaccessible to the surveyor at the time of survey, nor the internal parts of the engine/machinery. No destructive testing will be accomplished. No rigging inspection above eye level will be accomplished.

Your survey report is CONFIDENTIAL AND PROPRIETARY and for your use as you see fit. The Marine Survey Report content remains the property of the undersigned. The survey report purchaser(s) may use the document for Purchase Process, Insurance, or Repair Estimates only. The undersigned surveyor reserves the right to amend or add to the final survey report when additional pertinent information is presented. Any adjustment in Valuation will be considered with the presentation of information unknown or discoverable to the undersigned at the time of inspection.

The services rendered and the report are provided with the distinct understanding that the marine surveyor is not responsible nor liable under any circumstances whatsoever for any error, negligence or failure to perform the requested services and that all matters and statements made or in connection herewith shall be a basis for any claim, demand, or action against the marine surveyor. If there is any dissatisfaction with the services provided, it is understood that the sole remedy to you will be the return of the fee paid for the survey service. Under no circumstance will the compensation exceed the fee paid for the survey.

Survey Time: The survey time represents the necessary allotment to properly inspect the vessel, and is by its very nature variable.

Amendments: If the undersigned is required by their insurance provider to address Findings discovered in the survey and an Amended Report is requested, a charge of $100 will be incurred.

Cancellation/Postponement: If for any reason, beyond weather/unsafe conditions, this service is cancelled/postponed prior to the on-site inspection, a minimum fee of $200, plus expenses incurred, will be charged.

Payments Due: Payments are due and payable in advance /at time of inspection in US funds.

Report Submission: The marine survey report will be sent by email to the provided address unless otherwise agreed. Fluid Analysis report delivery time is outside the purview of the surveyor.

This request for survey will be construed to be acceptance of the above conditions. I have read, understand and agree to the stated terms.
